apparel business selling made-to-order products fulfilled by third-party production partners.
1. About Us
These Terms and Conditions ("Terms") govern the sale of products through the website operated by Birdie Hut
("we", "us", "our").

By placing an order through our website, you agree to be bound by these Terms.
2. Products
Birdie Hut sells clothing and apparel featuring original artwork and designs. All products are manufactured to order
after payment has been received.
Products are produced by third-party production partners and may be shipped directly from overseas production
facilities.
Product images are provided for illustrative purposes only. Whilst we make reasonable efforts to display products
accurately, colours, print placement, garment finish and appearance may vary slightly due to screen settings,
manufacturing processes and production methods.
Sizing information is provided as accurately as possible. Customers are responsible for checking the relevant size
guide before placing an order.
3. Orders
By placing an order, you are making an offer to purchase the selected products subject to these Terms.
An order is accepted only when payment has been received in full and an order confirmation has been issued.
We reserve the right to refuse, cancel or limit any order, including where:
• A product is unavailable;
• There is a pricing, listing or product description error;
• Fraudulent, unauthorised or suspicious activity is suspected;
• Payment cannot be verified; or
• These Terms have been breached.
Orders cannot usually be cancelled or amended once production has begun, as the products are made to order.
4. Pricing and Payment
All prices are shown at checkout in the applicable currency. Payment must be made in full before production
begins.

We reserve the right to amend prices at any time. Price changes will not affect orders already accepted and paid
for.
5. Manufacture and Fulfilment
All products are manufactured to order by third-party production partners. Orders may be produced and shipped
directly from international manufacturing facilities, including facilities located outside the United Kingdom.
Production and delivery timeframes stated on the website are estimates only. Whilst we aim to meet stated
timeframes, delays may occur due to production schedules, courier performance, customs processing, public
holidays or circumstances outside our reasonable control.
6. Shipping and Delivery
Customers are responsible for ensuring that delivery details are accurate and complete at the time of order.
We are not responsible for failed delivery, delayed delivery or additional costs arising from inaccurate, incomplete
or incorrectly entered delivery information supplied by the customer.
Goods will be considered delivered when delivered to the address provided by the customer or to a person
nominated by the customer. Risk in the goods passes to the customer at that point.
7. Customs Duties and Import Charges
Products may be shipped internationally from overseas facilities. Depending on the delivery location, customs
duties, import taxes, VAT, handling charges or similar fees may be imposed by local authorities.
Unless expressly stated otherwise at checkout, all such charges are the responsibility of the customer. We are not
responsible for delays caused by customs authorities.
8. Returns, Refunds and Replacements
8.1 Made-to-Order Products and Cancellation Rights
All products are made to order. Where products are personalised, customised or produced specifically for a
customer, the statutory right to cancel may not apply under applicable consumer legislation.
This does not affect your statutory rights where goods are faulty, damaged, not as described or otherwise fail to
meet legal requirements.
8.2 Returns Eligibility
To request a return, customers must contact us at cmwr.81@gmail.com within 7 calendar days of receiving the
order.
Returned items must be unworn, unused, unwashed, free from stains, odours, marks, damage or misuse, and
returned with original labels and packaging where applicable.
We reserve the right to reject returns that do not meet these conditions. These conditions do not apply where
goods are faulty, damaged or not as described.
8.3 Return Shipping Costs
Unless the item is faulty, damaged or supplied incorrectly, customers are responsible for return shipping costs. We
recommend using a tracked postal service.
Original shipping charges are non-refundable unless required by law.

Customers are responsible for selecting the correct size prior to ordering. Due to the made-to-order nature of our
products, returns or exchanges for incorrect sizing may be refused unless required by law.
8.5 Faulty, Damaged or Incorrect Products
If you receive a product that is damaged, defective, misprinted, incorrectly manufactured, supplied incorrectly or
materially different from the item ordered, you must contact us within 7 calendar days of delivery and provide your
order number, a description of the issue and clear photographs showing the defect or problem.
Where a valid issue is confirmed, we may provide a replacement, refund, store credit or other appropriate remedy.
8.6 Consumer Rights
Nothing in these Terms excludes or limits statutory rights available to consumers under applicable law.
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for purpose and as described. If
goods do not meet these standards, customers may be entitled to appropriate remedies including repair,
replacement or refund.
Approved refunds will be issued to the original payment method unless otherwise agreed.
9. Intellectual Property Rights
All artwork, illustrations, graphics, designs, logos, branding, product designs, website content, photographs and
creative materials displayed on this website are the property of Birdie Hut or its licensors and are protected by
copyright, trademark and intellectual property laws.
No content may be copied, reproduced, modified, adapted, distributed, published, sold, licensed, displayed publicly
or used for commercial purposes without prior written permission.
The purchase of any Birdie Hut product does not transfer any copyright, trademark or intellectual property rights to
the purchaser.
10. User Conduct
By using this website, you agree not to use the website unlawfully, attempt unauthorised access, interfere with
website security or operation, upload harmful software, scrape or copy website content without permission, or
infringe intellectual property rights.
11. Limitation of Liability
To the fullest extent permitted by law, our liability in connection with any order shall be limited to the amount paid
by the customer for the relevant order.
We shall not be liable for indirect, consequential, incidental or special losses arising from the use of our website or
products.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or
fraudulent misrepresentation, or any liability which cannot be excluded under law.
12. Force Majeure
We shall not be liable for delay or failure to perform obligations due to circumstances beyond our reasonable
control, including natural disasters, floods, fires, pandemics, government action, industrial disputes, supply chain
interruptions, internet outages, manufacturing delays, courier delays or transport disruption.

Personal information collected through our website is processed in accordance with our Privacy Policy. By placing
an order, customers acknowledge that personal information may be used for order processing, fulfilment, customer
service and legal compliance.
14. Governing Law
These Terms are governed by and interpreted in accordance with the laws of England and Wales. Any disputes
arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
